First Star Software, Inc., the copyright owners of Boulder Dash, contacted me and demanded that I removed this game from java4k.com. I had no other choice but to comply.  Undecided

Wow; just WOW!

A company defending a 28 year old copyright? against a clone?!
I guess we have the iphone & other mobile platforms to blame for such madness.

Though i'm curious how the source code could breach copyright in any way? it's an original work afterall.

You shouldn't really have to change more than the name. Can't copyright game mechanics. Presumably the sprites weren't the actual originals. Level design not a total rip either?

actually yes, the levels are the same and the sprites are as close as i could make them...

re: the source, i do not want to jeapodise my chances for an appeal by having the source available.

Shame to lose the game! Can't you just change the name/graphics a bit? They can't copyright game mechanics... For a new name how about: 'Miner Infringement'?!

Boulder Dash(R) is a highly valued Intellectual Property, which we still very actively exploit and we must do what we can therefore to be sure that we do not take any action that could be referred to as letting the game lapse into the 'public domain'.
 
As for trying to outline how you could modify the entry so that it did not infringe upon our copyrights: that is not something we would dare venture to do. Copyrighted materials does not lend itself to that sort of analysis.
 
Again, I am sorry. I know this is not the answer you were hoping for; but, we simply can not make an exception or set a dangerous precedent.

Ah well.. with my first baby due later this month, i do not think i will have time to overhall the game to make it not infringe Sad

If some one else is interested in taking ownership i can give them the source code, and tools i made for level data and image data generation.

Beautiful example of someone not understanding copyright. Do you think he asked his lawyer for advice and didn't listen carefully or just wrote it without reference to a lawyer?

But it is! You can't copyright concepts or ideas, only implementations.
You can PATENT concepts and ideas, though. But in many places (like most of Europe, at least) software patents aren't legal.

Moogie: Just rename it and add replace the art with original art! It's a wonderful achievement, and it needs to be played!

I think the level designs are probably also susceptible to copyright protection, at which point Moogie's time constraints bite hard.

Well, last night i have tried my hand at custom pixel sprite animation replacing Rockford with a drilling machine... not the best but not too bad either. perhaps if i spend a couple of hours a night i may be able to change the game sufficiently in time for the end of the contest...

ok now I'm worried about my game... I was doing an Elevator Action clone in 4k. Hope Taito won't mind about it...

anyway, moogie are you able to share just a small part of your game? I'm planning a new entry that will use tile-based levels so I was thinking if you could post just the code for the tile map part. You could replace sprites with just a spot rolling over in a scrollable tile map. Would you mind? That would cut a lot of my work, and I think your code is already optimized for size.

thanks! It was a great entry and it would probably fight for top places.
